Key Requirements
You may qualify for indefinite leave to remain (ILR) if you have:
10 years continuous lawful residence in the UK
No single absence exceeding 180 days in any 12-month period during the qualifying period
Maintained lawful immigration status throughout
No serious criminal record or major breaches of immigration rules
Important Notes
The 10-year period is calculated from your date of entry into the UK, not from the issue date of your first visa.
Standard processing time: Up to 6 months (priority services may be available for faster processing)
You can apply up to 28 days before meeting the full 10-year requirement
Maintaining Your ILR Status
If you leave the UK for more than 2 consecutive years, your ILR status will automatically lapse
To return after extended absence, you must apply for a Returning Resident visa
Historical note: There have been cases where students maintained ILR status despite extended absences (e.g., 5 years) prior to September 2025. However, current rules strictly enforce the 2-year limit. Always verify your status before travelling.
Essential Reminders
Keep detailed records of all entries/exits and immigration documents
Seek professional advice if you have complex absence patterns
Check the latest rules at GOV.UK before applying
